Nebraska Small Claims Court Defendant Checklist: Prepare Your Defense
You've been served with a Nebraska small claims lawsuit and the hearing is coming up. Unlike regular civil court, there's no written answer to file — your entire defense happens at the hearing. That makes preparation everything. Here's what to do, in order, from the day you're served.
Immediately After Being Served
- Read Form CC 4:1 completely. Note the case number, court venue, hearing date/time, and the plaintiff's claim amount.
- Verify the case through the JUSTICE case search at nebraskajudicial.gov or by calling the County Court Clerk.
- Preserve your service envelope and any postal receipts — they prove when and how you were served.
- Calendar the hearing date and set a reminder for two days before it (that's your last chance to file a counterclaim or request a transfer).
Decide Your Strategy
You have three core approaches:
Dispute the claim. You believe you don't owe what the plaintiff says, and you'll present evidence to prove it. This is the most common defense.
Counterclaim. The plaintiff owes you money from the same dispute. File Form CC 4:2 at least two full days before the hearing. You must serve it on the plaintiff by certified mail or sheriff.
Transfer the case. You want a lawyer, a jury, or your counterclaim exceeds $7,500. File Form CC 4:3 and pay the $20 fee at least two days before the hearing.
If you agree you owe money but want to negotiate the amount or set up a payment plan, contact the plaintiff before the hearing to discuss settlement.
Prepare Your Evidence
Nebraska small claims judges decide cases on the evidence presented at the hearing. No discovery, no depositions — just what you bring that day.
Documents to gather:
- Contracts, leases, or written agreements
- Receipts, invoices, and payment records
- Photographs (timestamped if possible) of property, damages, or completed work
- Text messages and emails (printed, not shown on your phone)
- Repair estimates or professional opinions
Formatting rules:
- Print three complete copies of every document — one for the judge, one for the opposing party, one for yourself.
- Number your pages sequentially.
- Digital evidence (video, audio) must go on new, unused USB flash drives — three drives, one per party plus the judge. Douglas County enforces this strictly under local rule CC 4:20.D4.
- The court will not view evidence on your phone, tablet, or laptop.
Witnesses:
- Bring anyone who has firsthand knowledge of the dispute.
- Written witness statements are inadmissible — the witness must appear in person.
- If a witness refuses to come voluntarily, file Form CC 4:6 (Praecipe for Subpoena) with the clerk, along with the $8 witness fee plus mileage.

The Day of the Hearing
- Arrive 15 minutes early and check in with court staff.
- Dress presentably — business casual works.
- Silence your phone.
- When called, the plaintiff presents first. Listen carefully and take notes. You'll get a chance to cross-examine.
- Present your defense: state the facts, walk the judge through your documents, and let any witnesses testify.
- Address the judge, not the plaintiff. Stay calm even if the plaintiff's claims feel outrageous.
The judge either rules from the bench or mails the decision. Either way, you'll get a written order.
After the Hearing
If you win, the case is dismissed. If the plaintiff wins but you believe there was a legal error, you have 30 days to appeal to District Court (Form CC 9:2, $50 bond, $144 docket fee). If you lose and the amount is correct, you can pay the plaintiff directly — but make sure they file Form CC 4:8 (Satisfaction of Judgment) with the court afterward.
