Montana Small Claims Court Landlord-Tenant Disputes — Defendant's Guide
Landlord-tenant disputes can involve specific statutory requirements. Whether you're a tenant being sued for property damage or unpaid rent, or a landlord being countersued over a withheld security deposit, organize the records that document the claim and the property's condition.
What Montana Small Claims Can and Can't Handle
Small claims court in Montana handles money disputes up to $7,000. It does not handle evictions. If you're a tenant worried that a small claims lawsuit means you're being kicked out — it doesn't. Eviction proceedings (forcible entry and unlawful detainer) go through the general civil division of Justice Court or City Court under a separate fast-track procedure with a 5-business-day written answer deadline.
A landlord filing in small claims is suing for money: unpaid rent, cleaning costs, property damage, or lease-break penalties. A tenant filing a counterclaim may seek return of a security deposit.
Security Deposits and MCA § 70-25-204
Montana's security deposit law under MCA § 70-25-204 sets requirements relevant to security-deposit disputes:
The written accounting requirement. After a tenant moves out, the landlord must provide a written itemized statement of any deductions from the security deposit within the time required by the statute. Keep the statement, or note if none was provided, with the other records for the dispute.
Condition records. If you dispute a deduction as ordinary wear and tear or damage, organize move-in and move-out inspection forms, dated photos, and the landlord's written itemized statement. These records help document the property's condition and the deductions being challenged.
Organize the accounting. A tenant can compare the landlord's itemized statement with inspection forms, photos, and communications about the property's condition. Keep evidence of any missing accounting or inspection records as well.
Defending as a Tenant
If your former landlord is suing for property damage or unpaid rent, your key evidence includes:
- Move-in inspection form showing pre-existing conditions
- Move-out photos (timestamped) showing the property's condition when you left
- Communication records — emails, texts, or letters about maintenance requests, rent disputes, or move-out procedures
- Rent payment records — bank statements, receipts, or canceled checks
- The lease agreement — terms about damage responsibility, cleaning expectations, and deposit conditions
If the landlord didn't provide a move-in inspection checklist, note that gap and keep any other evidence showing the property's original condition.

Filing a Counterclaim for Your Deposit
If the landlord withheld your security deposit and you believe the deductions were improper, you can file a Small Claims Counterclaim for up to $6,500. The 72-hour service rule applies — your counterclaim must be served on the landlord by a sheriff or process server at least 72 hours before the hearing time.
Bring copies of:
- The lease showing the deposit amount
- Any written accounting the landlord provided (or evidence they didn't provide one)
- Your move-out photos and inspection records
- Evidence of any maintenance issues you reported that went unaddressed
Common Pitfalls
Don't confuse small claims with an eviction defense. If you're being sued for money and separately facing eviction proceedings, those are two different cases with different deadlines and procedures.
Don't ignore the hearing. A default judgment for the full amount claimed gets entered if you don't show up, regardless of how strong your defense might be.
Keep records of lease terms and payments. If the lease was oral, organize payment records and any written communications about the agreement.
