Can You File Small Claims Online in Montana?
If you're searching for a way to file your Montana small claims case from your computer, the short answer is no — Montana does not offer online filing for small claims cases. Understanding why, and how to file efficiently in person, saves you a wasted trip to a courthouse website that doesn't have what you need.
Why Montana Small Claims Can't Be Filed Online
Montana's Courts of Limited Jurisdiction (Justice Courts and City Courts) do have e-filing systems for standard civil cases. But the Small Claims Division is explicitly excluded. The reason is procedural: under MCA § 25-35-602, the small claims complaint must be signed under oath in the presence of the Justice of the Peace or the court clerk. That sworn signature — the jurat — is a statutory requirement, not just a formality.
This in-person oath requirement means you must physically visit the Justice Court clerk's office to file. No county in Montana currently accepts small claims filings by email, fax, or online portal.
What You Can Do Online
While you can't file online, you can prepare everything before your clerk visit:
- Download forms from the Montana Judicial Branch website (courts.mt.gov/forms/civilforms). The Small Claims Complaint and Order of Court, the Praecipe, and the fee waiver affidavit are all available as downloadable PDFs.
- Look up the defendant's business information on the Montana Secretary of State's business entity search to get the correct legal name and registered agent.
- Check your local court's hours and fee schedule. County justice court websites list clerk office hours (some rural counties have limited hours — Teton County, for example, operates only 8:00 AM to noon) and accepted payment methods.
The In-Person Filing Process
Walk into the Justice Court clerk's office in the county where the defendant resides or where the dispute occurred. Bring:
- Your completed Small Claims Complaint (fill it out beforehand — leave the oath unsigned until you're in front of the clerk or judge)
- The completed Praecipe with the defendant's service address
- Proof of your demand letter and certified mail receipt (required by many counties)
- Your filing fee — typically $30 with surcharges (cash or check only in some counties like Park County)
The clerk will have you sign the complaint under oath, accept your fee, assign a case number, and set a hearing date within 10 to 40 days. The entire filing visit usually takes 15 to 30 minutes if your paperwork is complete.

Filing by Mail
MCA § 25-35-601 says a small claims action is commenced when the claimant appears before a Justice of the Peace or the clerk and executes the sworn complaint. Mailing an unsigned complaint does not start the case. Contact the clerk if you need help preparing the paperwork before appearing to swear to the complaint.
For most litigants, preparing the paperwork before visiting the courthouse is faster and more reliable.
The Montana Small Claims Filing Guide includes a filing-day preparation checklist that covers everything you need to bring to the clerk's office, so one trip gets it done.
