How Long Does Small Claims Court Take in Michigan?

You want your money back, and you want to know how long this whole process actually takes. The initial hearing date must be 15 to 45 days after the notice is issued. The district court sets the date within that window, and service problems or court motions can add time. Here's what to expect at each stage.

Filing to Hearing Date: 15 to 45 Days After Notice

When you file Form DC 84 and pay the filing fee, the court clerk schedules a hearing date. Under MCL 600.8406, the initial appearance date must be at least 15 and no more than 45 days after the notice date. The court's calendar determines the date within that range.

District courts set dates within that range based on their calendars. Ask the court clerk for the date on your notice.

The court clerk sends the hearing notice to the defendant along with a copy of your claim. Process must be served at least seven calendar days before the hearing date. If service fails (the certified mail comes back unclaimed), request a new notice setting a hearing date 15 to 30 days after the new notice is issued, then arrange personal service. The additional time depends on how quickly the new notice and service are completed.

The Hearing Itself

Small claims hearings are informal. You'll present your evidence and testimony, the defendant (if they appear) presents theirs, and the magistrate or judge asks questions to clarify the facts. The length depends on the issues and the court's schedule.

At the conclusion of testimony, the court enters its judgment.

After the Judgment: Collection Is the Wild Card

Here's where the timeline gets unpredictable. Winning a judgment doesn't mean getting paid. A defendant may pay voluntarily after the hearing, but the court does not collect the money for you.

If they don't pay, you enter a separate collection process. Execution cannot begin until after the 21-day stay following judgment.

  • Wage garnishment (Form MC 12) — one of the separate post-judgment collection procedures. The filing and service steps are covered in the judgment-collection guide.
  • Bank account garnishment (Form MC 13) — another separate enforcement procedure; see the judgment-collection guide for the steps.
  • Debtor examination — a separate procedure available through the civil division when you need information about the debtor's assets.

Collection timing depends on the debtor's response and the enforcement steps required after the stay.

What Causes Delays

Several things can stretch your timeline:

  • Failed service of process — unclaimed certified mail requires personal service and may require a new hearing date; the added time depends on the court's calendar
  • Adjournments — if you need more time, request a formal adjournment from the court; the new date depends on its calendar
  • Removal to general civil court — if a party demands removal under MCL 600.8408, formal procedures, including discovery, apply and can lengthen the case
  • Counterclaims — counterclaims up to $7,000 are heard with the primary suit; a larger counterclaim triggers a transfer to the General Civil Division
  • Magistrate appeals — either party may appeal a magistrate decision within seven calendar days for a new hearing before a District Court Judge

Procedural Dates to Track

For a straightforward case with successful service and no complications:

Event Timing
Demand letter response window 10–14 calendar days is a reasonable requested deadline
Initial hearing date 15–45 days after the notice is issued
New hearing notice after failed service 15–30 days after the new notice is issued
Service before hearing At least 7 calendar days
Appeal from a magistrate decision Within 7 calendar days of entry
Execution after judgment After the 21-day stay

There is no reliable statewide total from demand letter to payment. The hearing date is set by the court, and collection after judgment follows a separate process.
