Loudoun and Prince William County Small Claims Court: Filing Guide

Filing Small Claims in Virginia's Outer Northern Virginia Suburbs

Loudoun County and Prince William County are two of Virginia's fastest-growing jurisdictions, each with its own General District Court and Small Claims Division. Both follow the same statewide framework — claims up to $5,000 on Form DC-402, with parties generally representing themselves subject to statutory exceptions, and informal hearings — but the rapid population growth in both counties has pushed up docket volumes and made a few local details worth noting.

Loudoun County General District Court

Location: 2 Church Street NE, Leesburg, VA 20176-2828

Loudoun County's courthouse is in historic downtown Leesburg. The civil clerk's office handles small claims filings at the counter and by mail. Filing fees follow the statewide schedule: $35–$38 for claims up to $500, $50–$57 for $500.01–$5,000, plus $12 per defendant for sheriff service.

Loudoun has seen dramatic residential and commercial growth along the Route 7 and Route 28 corridors. Many disputes involve new-construction homeowner complaints against builders, contractor deposit disputes, and landlord-tenant cases in the county's large rental market.

Data center and tech industry defendants: Loudoun County hosts more data centers than anywhere in the world, along with the corporate offices of numerous technology firms. If you're suing a business entity, the registered agent may be at a professional service address rather than the company's operating location. Always check the SCC CIS portal for the exact registered name and agent address.

Prince William County General District Court

Location: 9311 Lee Avenue, Manassas, VA 20110

Prince William County's courthouse is in Manassas. The civil clerk's office accepts small claims filings during business hours. Same statewide fees apply.

Prince William County's small claims docket reflects its mix of suburban residential communities and small businesses along the I-95 and Route 1 corridors. Common case types include contractor disputes, auto repair disagreements, and security deposit claims.

Note that the independent cities of Manassas and Manassas Park, while geographically surrounded by Prince William County, have their own General District Courts. If the defendant lives within Manassas or Manassas Park city limits — not in unincorporated Prince William County — you file in that city's court instead.

Venue Rules

Under Va. Code § 8.01-262, file in either county's court if:

  • The defendant resides or has a principal place of employment there
  • The defendant's principal place of business is located there
  • The defendant's registered agent is in that jurisdiction
  • The cause of action arose there

Both counties border Fairfax County to the east. If you live in Loudoun but the defendant is in Prince William, you file in Prince William (or wherever the cause of action arose). The plaintiff's residence alone isn't valid venue except as a last resort.

What to Expect at the Hearing

Both Loudoun and Prince William courts schedule small claims on designated civil docket days. Hearings are informal — the judge hears testimony directly and reviews documents without strict evidence rules. Bring three copies of all evidence: one for you, one for the judge, one for the defendant.

Voluntary mediation may be available before your hearing in both courts. If you reach a settlement through mediation, the agreement becomes a binding court order. If not, the case proceeds to the judge.

Removal risk: In either jurisdiction, a defendant may remove the case under Va. Code § 16.1-122.4(B) at any point before the judge hands down a decision, moving it to the regular General District Court docket, where attorneys may appear. This can matter when the defendant is a well-established business. It doesn't change your evidence or the legal standards — it changes the formality of the proceeding.
