Florida Small Claims Court Forms

Statement of Claim Forms

The Statement of Claim is the form that officially starts your case. Florida's Small Claims Rules (Rule 7.300 series) provide standardized versions, and which one you use depends on what your dispute is about:

  • General monetary claims — there is no statewide general Statement of Claim numbered Form 7.322. Use the small-claims Statement of Claim provided by your county clerk unless a statewide form fits your claim.
  • Form 7.332 — work done and materials furnished. Use this for contractor disputes, repair work invoices, and labor/materials claims.
  • Form 7.330 — auto negligence. Specifically for vehicle collision damage claims. If you're suing over a car accident, this is the form.
  • Form 7.333 — money lent.
  • Form 7.334 — promissory note.
  • Form 7.335 — return of stolen property from a pawnbroker. It applies to stolen or misappropriated property held by a pawnbroker, not pawned property generally.

A common mistake: using Form 7.332 for all claims because it mentions "work done." Form 7.332 is only for labor and materials disputes. A general breach of contract or debt collection action uses the county clerk's general small-claims Statement of Claim.

Civil Cover Sheet (Form 1.997)

The statewide Civil Cover Sheet (Form 1.997) is not required for small-claims cases. County clerks may provide local small-claims information sheets or other intake forms, so check the filing list for your county.

Miami-Dade's standard civil cover sheet instructions also exempt small-claims cases; its separate Small Claims Block Filing Cover Sheet is for block filings.

Email Service Designation (Form 2.601)

Florida's e-service rules under Rule 2.516 generally require electronic service after the initial filing. An unrepresented party may request exemption using Form 2.601 only if they have no email account or no regular access to the internet, and must declare that under penalty of perjury.

Without the exemption, you'll need to provide a valid email address for receiving court documents after the case is filed. If you use the E-Filing Portal, it handles e-service automatically through your portal account.

Authorized Representative (Form 7.350)

If a business — a corporation, LLC, or partnership — is the plaintiff or defendant, it does not always need a lawyer in the trial court. Under Rule 7.050(a)(2), it may be represented by a principal with legal authority to bind the business or by an employee authorized in writing by such a principal.

Form 7.350 is the Authorization to Allow Employee to Represent Business Entity at Any Stage of Lawsuit. A non-attorney may not represent the business entity on appeal.

Other Forms You May Need

  • Form 7.340 — Final Judgment form, used by the court to enter judgment after the hearing
  • Form 7.343 — Fact Information Sheet, a post-judgment financial disclosure the losing party may be required to complete
  • Form 7.322 — Summons/Notice to Appear for Pretrial Conference, issued by the clerk
  • Form 7.323 — Pretrial Conference Order and Notice of Trial

What to Attach at Filing

Rule 7.050(a) requires you to attach a copy or material part of any written document your claim is based on. These go in with the Statement of Claim as Tier 1 attachments.

Don't attach photos, text messages, or other supporting evidence at filing — those are Tier 2 exhibits that you bring to the hearing. The Portal's trial-court submission limit is 50MB in aggregate; check its current technical standards before uploading a large exhibit packet.

Where to get the forms: your county clerk's website, the Florida Courts website, or the E-Filing Portal (which populates them digitally during the filing workflow). Our Florida Small Claims Filing Guide walks through filling out each form with the exact entries for your claim type.
