Filing a Small Claims Reply by Mail or Fax in Saskatchewan

Not Everyone Can Walk into the Courthouse

If you live outside Regina or Saskatoon — or can't take time off during registry hours — getting to the Provincial Court in person to file your Form B Reply can be a real obstacle. Saskatchewan doesn't have an online e-filing system for small claims, but you have two alternatives to in-person filing: mail and fax.

Filing by Mail

You can mail your completed Form B to the Provincial Court registry identified on your Form A Summons. Here's what needs to be in the envelope:

  • The completed Form B — signed, with all applicable sections filled out (dispute, admission, counterclaim, or a combination)
  • Payment of the $50 filing fee — if paying by cheque, make it payable to "Small Claims Court"; do not send cash in the mail. Call the registry to confirm what other payment options it accepts for a mailed Form B
  • An additional $50 if filing a counterclaim — total of $100 in that case

Mail it to the court registry address listed on your summons. The two main registries:

  • Regina: 1815 Smith Street, Regina, SK, S4P 2N5
  • Saskatoon: 220 19th Street East, Saskatoon, SK, S7K 0A2

For other locations (Prince Albert, Moose Jaw, and circuit courts), look up the address on the Saskatchewan Courts website or call the registry directly.

The Timing Risk

Filing by mail means you're at the mercy of Canada Post delivery times. Your Form B must be received and accepted by the registry — not postmarked — at least 10 days before your court appearance date. A cheque that doesn't clear or a form that arrives late means your filing isn't complete.

If your appearance date is tight, calculate backwards generously. Mail within Saskatchewan typically takes 2-4 business days, but delays happen. If there's any doubt about whether mail will arrive in time, consider fax or making the trip in person.

Filing by Fax

Some Provincial Court registries accept fax filings. This is faster than mail, but it comes with conditions:

  • Call the registry first to confirm they accept fax filings and to get their current fax number
  • Arrange fee payment — fax doesn't physically deliver a cheque. Call the registry to find out how to pay the $50 fee when submitting by fax
  • Keep your fax transmission confirmation as proof of the date and time you sent it

Not every registry accepts fax — this varies by location and staffing. Don't assume it's available without checking.

Email Filing

Individual registries may accept documents by email. This is not standardized across the province. Contact your specific registry to ask whether it accepts Form B submissions by email and how fee payment works.

Which Method to Use

Method Speed Fee Payment Best When
In person Immediate Cash, cheque, or credit card at the court office You're near the courthouse and want certainty
Fax Same day (if accepted) Phone payment or arranged with registry Tight deadline, registry confirms fax is accepted
Mail 2-4+ business days Cheque; do not send cash Plenty of time before the 10-day cutoff

Don't Forget the Second Step

Filing Form B with the court is only half the obligation. You must also serve a copy on the plaintiff before the 10-day deadline. Filing and service are independent requirements — completing one doesn't satisfy the other.

If you're filing by mail from a rural area and serving the plaintiff by registered mail as well, both pieces of mail need to arrive in time. Start early. The margin for error shrinks fast when everything depends on postal delivery.

The Responding to a Small Claim in Saskatchewan guide includes a deadline worksheet and a service execution tracker specifically designed for defendants who need to manage remote filings — so you can confirm every step is completed before the cutoff.
