Free Legal Help for Delaware Small Claims Court Defendants

Where to Start: Delaware Legal Help Link

If you've been sued in Delaware's Justice of the Peace Court and can't afford an attorney, Delaware Legal Help Link (delegalhelplink.org) is the central intake point for civil legal aid statewide. It routes you to the right organization based on your situation, income level, and county.

Call or submit an online inquiry, and they'll connect you with the provider that handles your type of case.

Community Legal Aid Society (CLASI)

CLASI serves low-income individuals, seniors over 60, people with disabilities, domestic violence survivors, and subsidized housing residents. Their services include legal representation, advice, and referrals.

Office Phone Counties Served
Wilmington (302) 575-0660 New Castle
Dover (302) 674-8500 Kent
Georgetown (302) 856-0038 Sussex

Important limitation: CLASI focuses on housing, disability rights, elder law, and domestic violence. They generally do not handle contract disputes, contractor disagreements, or property damage defense cases in JP Court. If your case falls outside their scope, they'll refer you elsewhere.

Legal Services Corporation of Delaware (LSCD)

LSCD provides free legal help to low-income Delaware families. Their focus areas include consumer debt defense, housing eviction defense, unemployment appeals, and bankruptcy.

Office Phone
Wilmington (302) 575-0408
Dover (302) 734-8820

LSCD is the strongest option if you're being sued over a consumer debt (credit cards, medical bills, personal loans). For non-consumer civil disputes like contractor claims or car sale disagreements, their capacity is more limited.

Delaware Volunteer Legal Services (DVLS)

DVLS coordinates pro bono attorneys who volunteer their time for qualifying residents. They handle a range of civil matters and are often the best path to getting an actual attorney assigned to your case at no cost.

  • Statewide phone: (302) 478-8680
  • Toll-free: 1-888-225-0582

Income eligibility is generally capped at 200% of the Federal Poverty Guidelines.

Limited Legal Assistance Program

The Self-Help Center at the Leonard L. Williams Justice Center in Wilmington offers one-time, free 15-minute appointments for eligible self-represented litigants. The program currently covers civil family law, not general small-claims cases, and it does not provide ongoing representation.

Appointments are required. The posted civil family-law hours are Thursdays, 11 AM–1 PM; call (302) 255-0476 to schedule and be screened for eligibility.

What Free Legal Aid Can and Can't Do

Legal aid organizations can help you understand your rights, review your case, and sometimes represent you in court. But they have capacity limits and eligibility requirements. Not everyone qualifies, and not every type of case is covered.

Court clerks at the JP Court can also help with logistics — confirming hearing dates, verifying filings, supplying blank forms — but they are legally prohibited from giving you advice about your defense or telling you what to write on your forms.

If You Don't Qualify for Free Help

If your income is above the eligibility threshold, you have a few options:

  • Self-representation — Most JP Court defendants represent themselves (pro se). The court is designed for non-lawyers, and the procedures are simpler than Superior Court or the Court of Common Pleas.
  • Limited-scope attorney — Some attorneys will review your documents or coach you for a flat fee without representing you at trial.
  • Procedural guides — Our Delaware Small Claims Response Guide provides the step-by-step workflow that legal aid organizations often can't — deadline calculators, form-by-form instructions, and evidence checklists specifically for JP Court defendants.
