Connecticut Small Claims Fee Waiver: How to File Form JD-CV-120
Who Qualifies
You can ask the court to waive the $95 small claims entry fee based on your financial circumstances. The court reviews the application and decides whether you are indigent and unable to pay.
Public assistance: Receiving one of these benefits may support your application, but it does not automatically grant a waiver. Apply using Form JD-CV-120 and provide the financial information the court requests:
- SNAP (food stamps)
- SSI (Supplemental Security Income)
- TFA (Temporary Family Assistance)
- SAGA (State Administered General Assistance)
- State Supplement
Income and expenses: You may apply even if you do not receive public assistance. The court reviews the income, expenses, assets, and liabilities listed on JD-CV-120.
How to Apply
The form is JD-CV-120 — officially titled "Application for Waiver of Fees/Payment of Costs/Appointment of Counsel — Civil, Housing, Small Claims." Download it from jud.ct.gov or pick up a copy at any Superior Court clerk's office.
The form asks for:
- Your income sources and amounts
- Monthly expenses (rent, food, utilities, medical, transportation, child care)
- Whether you receive any qualifying public benefits
- Number of dependents
You must swear to the accuracy of the information before a court clerk, notary public, or attorney. Submitting false information under oath carries legal consequences.
File JD-CV-120 with the court where your case will be filed. If approved, the court can waive the $95 entry fee and/or order the state to pay a State Marshal's service cost up to the amount listed in the order. Postage and costs beyond that amount may not be covered.
If Your Application Is Denied
The court reviews the application. If it is denied, you may request a court hearing using the section on JD-CV-120; a denial does not end your ability to ask the court to review it.
If the waiver is denied outright and you still can't afford the fee, you can explore whether Connecticut Legal Services or Statewide Legal Services can help. These organizations provide free legal assistance to low-income residents, though their capacity is limited and they prioritize certain case types.

Timing
Because service must be completed before filing, arrange service before filing the writ. If you need the state to pay a State Marshal's fee, apply for that service-cost waiver in advance and give the marshal the court's signed order. If you are requesting only a filing-fee waiver, submit JD-CV-120 with your writ and proof of service.
The Connecticut Small Claims Filing Guide includes instructions for completing both JD-CV-120 and the main filing forms, with a checklist that covers the fee waiver path from start to finish.
