Filing a Small Claims Case for Car Accident or Property Damage in Nevada
Someone rear-ended your car and their insurance lowballed you, your neighbor's tree fell on your fence, or a contractor's crew damaged your driveway. If the repair bill is $10,000 or less, you can recover it through Nevada small claims court without hiring a lawyer.
What Property Damage Claims Fit Small Claims
Nevada small claims courts under NRS Chapter 73 award money only — up to $10,000. The court cannot order someone to fix your fence or repair your car. It can order them to pay what the repair costs. Common property damage claims include vehicle collision repair costs not covered by insurance, fence, wall, or landscaping damage from a neighbor's property, damage caused by a contractor during unrelated work, pet damage to property, and vandalism where you know who did it.
The statute of limitations for property damage is three years under NRS 11.190(3)(c), running from the date the damage occurred or was discovered.
Venue for Property Damage Cases
For claims involving physical property damage, NRS 73.010(2) gives you a venue option that other claim types do not have: you can file in the township where the damage occurred, not just where the defendant lives or works. If a driver hit your car in Henderson, you can file at Henderson Justice Court regardless of where the driver lives.
For neighbor disputes, the damage and the defendant's residence are usually in the same township. For car accidents, the accident scene determines your filing options.
The Evidence That Wins Property Damage Cases
Judges decide property damage cases almost entirely on documentation. Your evidence should include photos of the damage taken as soon as possible after the incident (with timestamps), a police report if one was filed (especially for car accidents), at least two written repair estimates from licensed contractors or certified mechanics, actual repair invoices if you already paid for the work, and any insurance correspondence showing what was offered and what you are still owed.
For neighbor disputes, add photos showing the property line, the source of the damage (the leaning tree, the broken fence post on their side), and any prior written communication where you asked them to address the problem.
Bring three complete copies of everything to the hearing — one for the judge, one for the defendant, one for you. Sparks Justice Court requires exhibits filed at least five judicial days before the hearing date.

How to Calculate Your Claim Amount
Claim the actual cost to repair or replace the damaged property, not an inflated or speculative number. If you have two repair estimates at $3,200 and $3,500, claim the reasonable repair cost. Judges are skeptical of round numbers with no supporting documentation.
You can also claim out-of-pocket expenses directly caused by the damage — rental car costs while yours was in the shop, for example — as long as you have receipts. Small claims courts can award supported money damages, including pain and suffering when the underlying claim allows them, up to the $10,000 cap.
Send a Demand Letter
Even when not strictly required (Clark County mandates it; Washoe County strongly expects it), a demand letter shows the judge you tried to resolve the dispute before filing. Send it by Certified Mail with Return Receipt. State the damage, the repair cost, and give a deadline for payment.
Filing and Service
In the major townships covered by the standard schedule, filing fees range from $66 to $196 based on the claim amount; rural court fees can vary. In Las Vegas, you file electronically through eFileNV. In Reno, Sparks, Henderson, and rural courts, you can file at the counter or by mail.
Serve the defendant through the Township Constable, a licensed process server, or any disinterested adult over 18. Under JCRCP Rule 91, service must be completed at least 14 days before trial. In Washoe County, service must be completed at least 20 calendar days before the scheduled mediation or trial.
