PEI Small Claims Litigation Guardian: When Form 4A Is Required

When a person under legal disability is named as a defendant in a PEI small claims case — a minor, or an adult who lacks the mental capacity to manage their own legal affairs — someone else must step in to run the defence. That person is called a litigation guardian, and they cannot act without filing Form 4A.

Who Needs a Litigation Guardian

Two categories of defendants require one:

Minors — Anyone under 18 named as a defendant in the Supreme Court of PEI, Small Claims Section. The person acting as litigation guardian must file Form 4A with the Statement of Defence.

Persons under disability — An adult who is mentally incapable of managing their legal affairs. Parties under legal disability must be represented by a lawyer; do not assume that a family member or caregiver can conduct the case without one.

What Form 4A Requires

Form 4A is the Consent to Act as Litigation Guardian. File it with the Statement of Defence (Form 9A). The form is available from the PEI Courts website under the Forms section.

Filing Timeline

File Form 4A with the Statement of Defence. If you cannot submit both by the response deadline, contact the registry and get legal advice promptly.

The response deadline is 20 calendar days if served in PEI, 40 days if served elsewhere in Canada or the US, or 60 days if served internationally. If more time is needed, the respondent should seek written consent from the claimant or a court-ordered extension before the deadline expires.
