NTCAT Form 2 Response: How to Fill In
If you've been served with a small claim in the Northern Territory, the Form 2 Response is the document you file with NTCAT to formally participate in the proceedings. It's not a "defence form" — that's court terminology from other jurisdictions — but it serves the same purpose: telling the tribunal your side and what orders you want.
Filling it in correctly matters. An incomplete or late Form 2 can leave you exposed to a default decision, where the tribunal issues orders against you without ever hearing your response.
Part A and Part B: Party Details
These sections capture the names and addresses of both parties. Copy the applicant's details exactly as they appear on the Form 1 Initiating Application you were served with — even if there's a minor error in the spelling. If the applicant got your name wrong (using a trading name instead of your legal entity name, for example), note the correct legal name in Part C.
Getting the party names right isn't just administrative. If you're responding on behalf of a company, the person signing the form warrants to NTCAT that they have lawful authority to bind that entity. A tribunal member can demand proof of that authority at the hearing.
Part C: Your Response and the Orders You Want
Part C is where you do the substantive work. You need to state clearly what decision or orders you're asking NTCAT to make — for example, "The application be dismissed" or "The claimed amount be reduced to $X."
Then set out the specific factual reasons for your position. This doesn't need to be a legal essay, but it does need to be concrete. Explain what happened, where the applicant's version is wrong, and what evidence supports your account.
A few principles to follow:
- Acknowledge undisputed facts. If you agree the contract existed but dispute the amount owed, say so. Narrowing the issues helps the tribunal focus on what actually matters.
- Don't attach evidence to the form. NTCAT procedural guidelines explicitly instruct respondents not to attach contracts, emails, invoices, or photos to the Form 2. Evidence comes later, when the tribunal issues specific directions about exchange deadlines.
- Be specific about your counterclaim. If you're making one, Part C is where you set out what the applicant owes you and why. Counterclaims that arise from the same transaction can go in the Form 2; if the counterclaim is unrelated, NTCAT may require you to file a separate Form 1.
Signing and Filing
The Form 2 must be signed by you personally, or by an authorized representative if you're a company. You can file it through three channels:
- Email: send it as a PDF attachment to [email protected]
- Post: mail to PO Box 41860, Casuarina NT 0810 (or PO Box 1745, Alice Springs NT 0870)
- In person: deliver to the Casuarina registry (13 Scaturchio Street) or Alice Springs registry (1 Stott Terrace) during business hours, 8:00 AM – 4:00 PM
Filing the Form 2 costs nothing — there's no fee for respondents.
Keep your proof of filing. That means the email transmission receipt, postal tracking number, or the stamped copy returned by the registry counter.

Don't Forget to Serve the Applicant
Filing with NTCAT and serving the applicant are two separate obligations. After you file your Form 2, you must also serve a copy on the applicant using an approved method (personal delivery, post to their address, or email if they've consented to electronic service). Then complete a Form 6 Unattested Declaration documenting when and how you served them, and lodge that with NTCAT as well.
Common Mistakes
The most frequent errors: missing the deadline printed on the standard orders, attaching evidence bundles to the Form 2 when they're not supposed to be there yet, using the wrong form entirely (NCAT Form 2 from New South Wales is a different document), and filing without also serving the applicant.
If you want a structured walkthrough of the entire Form 2 process — from verifying your deadline through each section of the form — the NTCAT Response Guide covers it step by step.
