Mississippi Demand Letter Before Small Claims: How to Write One That Works

You Don't Always Have to Send One — But You Almost Always Should

For most civil claims in Mississippi Justice Court, a pre-suit demand letter isn't legally required. You can walk into the clerk's office and file without one. But there's a significant exception: residential security deposit disputes.

Under Miss. Code § 89-8-21, the landlord's 45-day deadline starts only after the tenancy ends, the tenant delivers possession, and the tenant demands the deposit. The statute does not specify a written form for the tenant's demand, so put it in writing and keep proof of delivery. Without a tenant demand, the 45-day statutory period has not started.

Even when a demand letter isn't mandatory, sending one is smart strategy. It creates a documented record that you tried to resolve the dispute before dragging someone into court, and judges notice that. A well-written demand letter also forces the other side to take you seriously — many disputes settle after the letter arrives because the debtor realizes you're organized and willing to follow through.

What to Include

A Mississippi demand letter should cover these seven points:

  1. Your full name and current address
  2. The other party's full name and address — if it's a business, use the registered entity name from sos.ms.gov
  3. A clear description of the dispute — what was agreed, what went wrong, dates and specifics
  4. The exact dollar amount you're demanding — supported by receipts, invoices, or estimates
  5. A response deadline — 10 to 14 days from receipt is standard
  6. Your preferred payment method — check, bank transfer, or other specific instructions
  7. A statement that you'll file in Justice Court if the matter isn't resolved — keep it factual, not threatening

Avoid emotional language, insults, or legal jargon you don't fully understand. The letter may end up as an exhibit in court, and you want it to make you look reasonable and organized.

Send It by Certified Mail

Use USPS Certified Mail with Return Receipt Requested. This gives you two pieces of evidence: the certified mail receipt (proving you sent it) and the green return receipt card (proving it was delivered and who signed for it).

Keep the originals. If the case goes to trial, the judge can see exactly when the letter was sent and received, and there's no argument about whether the defendant knew about your demand.

Regular first-class mail works as a backup if the defendant refuses to sign for certified mail, but certified mail is the stronger proof.

Timing Matters

Send the demand letter before you invest time and money in filing. Give the recipient the full response deadline, then wait. If they pay, you've avoided at least the $25 civil case fee and the $55 constable service fee, before any other county-listed charges. If they ignore you, you now have a documented paper trail showing you tried.

For security deposit cases, timing is especially important. The landlord gets 45 days from the date all three conditions are met — tenancy terminated, possession surrendered, and the tenant's demand made. Count carefully using RJC Rule 13: exclude the day of the triggering event, include the last day, and extend past weekends or holidays if the deadline falls on one.

When the Deadline Passes

If the response deadline comes and goes with no payment or meaningful response, you're ready to file. Bring the demand letter, the certified mail receipt, and the return receipt card to the Justice Court clerk along with your complaint and filing fee.

The Mississippi Small Claims Filing Guide includes a demand letter worksheet with fill-in fields for every required element, plus a deadline calculator to track response windows for both general claims and security deposit cases.
