Landlord Sued Me in Small Claims Court Arkansas: Tenant Defense Steps
What Landlords Typically Sue For
Most landlord-filed small claims cases in Arkansas fall into three categories:
- Property damage beyond normal wear and tear — the landlord claims you left the unit in worse condition than when you moved in and the cost exceeds the security deposit
- Unpaid back rent — missed monthly payments or early lease termination without proper notice
- Cleaning and restoration charges — the landlord hired a cleaning crew or contractor after you moved out and wants reimbursement
These are monetary claims under the $5,000 small claims cap. If the landlord is also trying to evict you from a unit you still occupy, that's a different legal track (unlawful detainer under Arkansas Code Ann. § 18-60-307(b)), where a written objection to a notice seeking a writ of possession is due within five days, excluding Sundays and legal holidays. A small claims summons means the landlord wants money, not possession.
Your 30-Day Response Deadline Still Applies
File your written answer with the District Court Clerk within 30 calendar days of service (60 days if you are incarcerated). Use the answer form that came with the summons. Deny the claims you dispute, state your defenses, and file a counterclaim if the landlord owes you money.
This is the same deadline and process as any other small claims case. Don't assume a landlord-tenant dispute has special rules — it doesn't.
Common Tenant Defenses
Normal wear and tear. Compare the claimed charges with the unit's condition at move-in and move-out. Worn carpet after a three-year tenancy, minor scuffs on walls, and faded paint can help you challenge whether the amount claimed reflects damage beyond ordinary use. If the landlord seeks carpet replacement, bring records showing its age and condition.
Amount of claimed losses. If you broke the lease early, bring the lease, your notice to the landlord, and any evidence about efforts to re-rent the unit. Those records may help you dispute how the landlord calculated its claimed losses.
Inflated or undocumented charges. Request itemized receipts for every charge the landlord claims. A vague invoice for "$2,800 in damages" without photos, contractor quotes, or receipts is hard for the landlord to prove by a preponderance of evidence.
Security deposit disputes. Under Arkansas Code § 18-16-305, monetary disputes over security deposits can be brought in Arkansas small claims court when they are within the $5,000 jurisdictional limit. Gather the lease, move-out date, and any notice or itemization the landlord sent about deductions.

Filing a Security Deposit Counterclaim
If the landlord kept your security deposit without proper documentation, you can counterclaim within the same case. Your counterclaim goes on the answer form under "Affirmative Relief." Include:
- The amount of the deposit
- The date you moved out
- Any itemized deduction statement or notice the landlord sent about deductions
- Evidence that the deducted amounts were unreasonable or undocumented
Bring your lease, move-in and move-out photos (time-stamped if possible), any correspondence about the deposit, and the landlord's itemized statement (or proof they never sent one).
Evidence That Wins Tenant Cases
The strongest tenant evidence in landlord disputes:
- Move-in and move-out photos — side-by-side comparisons showing the unit's condition at both points
- The lease agreement — establishes what you were responsible for
- Communication records — texts or emails where you reported maintenance issues the landlord ignored
- Any itemized deduction notice — and records showing what the landlord sent and when
- Repair receipts — if you paid for repairs the landlord should have covered
Print everything. Prepare three copies — for the judge, the landlord, and yourself.
