Jefferson County Small Claims Court Alabama
Jefferson County handles more small claims cases than any other county in Alabama. If you've been served with papers from the Small Claims Division of Jefferson County's District Court in Birmingham, here's what you need to know about the courthouse, fees, filing logistics, and your response deadline.
Courthouse Location and Hours
The Jefferson County District Court (Birmingham Division) is located at the Jefferson County Courthouse, Room 400. The District Court Clerk is Jacqueline Anderson-Smith. Office hours are 8:00 AM to 5:00 PM, Monday through Friday, and the office stays open through lunch — unlike many rural Alabama courthouses that close from noon to 1:00 PM.
If you need to file documents in person, plan to arrive with enough time for the clerk to process your paperwork before 5:00 PM. Same-day filing is important when you're close to your 14-day answer deadline.
Filing Fees in Jefferson County
As a defendant, filing your answer (Form SM-03) is free. Here's the fee schedule for common counterclaim, service, default, and appeal filings:
| Action | Fee |
|---|---|
| Counterclaim up to $1,500 | $66.00 |
| Counterclaim $1,500.01–$3,000 | $140.00 |
| Counterclaim $3,001–$6,000 | $229.00 |
| Sheriff service per defendant | $10.00 |
| Default motion (claims over $3,000) | $50.00 |
| Circuit Court appeal (non-jury) | $351.00 |
| Circuit Court appeal (with jury) | $451.00 |
Jefferson County's filing fees are generally higher than rural counties but include some cost advantages — the $10 sheriff service fee per defendant is lower than the $25 listed for Cherokee County.
Your 14-Day Answer Deadline
The statewide rule applies in Jefferson County: you have 14 calendar days from the date of service to file your answer. This is governed by Alabama Small Claims Rule F and the deadline computation follows Rule 6(a) — count every calendar day starting from the day after service, with a weekend/holiday extension only if Day 14 lands on a non-business day.
You can file your answer three ways:
- In person — hand-deliver the completed Form SM-03 to the District Court Clerk at the courthouse
- By mail — send via certified mail to the clerk's physical address (must arrive by the deadline, not just be mailed by it)
- Online — submit through AlaFile (alafile.alacourt.gov) with a registered pro se account
After filing, serve a copy on the plaintiff by first-class mail.

Jefferson County vs. Bessemer Division
Jefferson County is split into two court divisions: Birmingham and Bessemer. If your case was filed in the Bessemer Division, the courthouse and clerk are different from the Birmingham Division described above. Check your Summons — it identifies which division your case is assigned to. The procedural rules (14-day deadline, same forms, same small claims rules) are identical; only the physical courthouse and local staff differ.
What Happens at the Hearing
Small claims hearings in Jefferson County follow the same statewide format: an informal bench trial before a District Judge, no jury. The plaintiff presents their case first, then you present yours. You can cross-examine the plaintiff's witnesses, and the plaintiff can cross-examine yours. Bring three copies of every document — one for the judge, one for the opposing party, one for yourself.
The Alabama Small Claims Response Guide covers the full response process with Jefferson County-specific details, including how to calculate your exact deadline, file through AlaFile, and prepare your evidence for the hearing.
