Hinds County Justice Court Mississippi: Filing, Fees, and Court Procedures

Court Location and Contact

Hinds County Justice Court's Jackson office is at 407 East Pascagoula Street. The county has multiple Justice Court districts; your summons will specify the district and hearing location for your case.

The court handles civil disputes where the claimed amount doesn't exceed $3,500 under Mississippi Code § 9-11-9. Common cases include contractor payment disputes, security deposit claims, unpaid service bills, and private sale disagreements.

Filing Fees and Cost Breakdown

Mississippi sets a uniform civil filing fee of $45 under Miss. Code § 25-7-25, plus a $5 civil legal assistance fund deposit. Constable service fees in Hinds County run between $30 and $45. Expect total initial costs of $84 to $100 whether you're filing a claim or a counterclaim.

Hinds County has a higher volume of civil filings than most Mississippi counties, so hearings can take longer to schedule. The clerk's office can confirm your hearing date and provide the docket number, but staff cannot give legal advice or help you decide how to respond — that's a statutory restriction, not unwillingness.

How the Justice Court Process Works

Hinds County Justice Court follows the Rules of Justice Court (RJC 1–27), not the Mississippi Rules of Civil Procedure. Two things catch people off guard:

No written answer is required. Unlike Circuit Court, where you generally have 30 days to file a formal response, Justice Court defendants contest a claim simply by appearing at the hearing date listed on the summons. A default judgment under RJC Rule 23 is triggered by failing to show up, not by failing to file a document.

Justice Court does not have statewide MEC coverage. Mississippi Electronic Courts (MEC) completed statewide implementation across Circuit, County, and Chancery Courts in June 2025. Electronic docket coverage in Justice Courts remains limited to select counties, so contact the Hinds County Justice Court clerk to confirm online access and filing options. An absent online record does not establish that a summons is fraudulent.

Preparing for Your Hearing

Bring three physical copies of every document you plan to present — contracts, invoices, photographs, text messages, emails. One set goes to the judge, one to the other side, and you keep the third for reference during testimony.

If you need someone to testify on your behalf, ask the Justice Court Clerk to issue a subpoena under RJC Rule 21. The constable serves it. Make that request well before trial day.

Courtroom rules apply even though the atmosphere is less formal than Circuit Court. Address the judge directly, stand when speaking, and arrive on time. Failing to appear can result in a default judgment under RJC Rule 23.

What Happens After the Hearing

The judge may rule from the bench or take the matter under advisement and issue a written decision later. Once the judgment is entered, the losing party has 10 calendar days to file a Notice of Appeal and post an appeal bond. The appeal goes to Hinds County Court or Circuit Court, as applicable, for a trial de novo — a complete retrial under the full Mississippi Rules of Civil Procedure.

The appeal bond is typically double the judgment plus estimated costs. If you can't afford it, an Affidavit of Indigency may allow you to proceed without it.
