Exempt Property Seizure Queensland — What a Bailiff Cannot Take
If you hold an enforcement warrant and a bailiff turns up at the debtor's home, they cannot take everything. Queensland and Commonwealth legislation protects certain categories of property from seizure, and knowing what is off-limits prevents you from wasting a $3,000+ security deposit on assets the bailiff has to leave behind.
Household Goods
Essential household furniture, kitchen equipment, bedding, and basic domestic appliances are protected from seizure. The debtor gets to keep a functioning household. A 15-year-old fridge and a secondhand dining table are safe. A luxury entertainment system or art collection may not be.
Tools of Trade
Tools and equipment used to earn income by physical exertion are protected up to $4,600 for the 2026–27 financial year. A tradie's hand tools, a photographer's camera, or a mechanic's diagnostic equipment may qualify; value above the limit can be seized.
Motor Vehicles
A vehicle or vehicles used mainly for transport are protected up to a combined equity limit of $9,950 for the 2026–27 financial year. Equity is the vehicle value less the secured amount still owed. The protection is not limited to the debtor's single primary vehicle.

Centrelink and Social Security
Centrelink payments cannot be garnished at the source from the Department of Social Services. This applies to all social security payments — JobSeeker, Age Pension, Disability Support Pension, and Family Tax Benefits. Once these funds are deposited into a regular bank account, the situation is more nuanced, but the direct-from-source protection is absolute.
Protected Earnings
When setting a Form 78 deduction, the court considers the debtor's necessary living expenses, other liabilities, and whether the deduction would cause unreasonable hardship. The rules set no fixed protected-earnings dollar threshold.
How Exemptions Interact With Bankruptcy
If civil enforcement fails and you pursue a Bankruptcy Notice (for debts of $10,000 or more), bankruptcy uses the Commonwealth exemption rules in section 116 of the Bankruptcy Act 1966 and regulations 27, 29, and 30 of the Bankruptcy Regulations 2021. The categories overlap — household goods, tools of trade, and vehicles — and the prescribed thresholds are indexed separately; AFSA publishes the current amounts.
What This Means for Creditors
Before applying for a Form 75 seizure warrant, estimate the value of the debtor's seizable assets after exemptions. If the debtor lives in a rented flat, drives a financed car, and works as a tradesperson with protected tools, there may be nothing left for the bailiff to take. In that case, a Form 78 earnings redirection or Form 76 bank redirection is a cheaper and more effective path.
