Disputes Tribunal NZ Fees: How Much Does It Cost to File a Claim?
Filing fees at the Disputes Tribunal are tiered by the amount you're claiming — and they're non-refundable, even if you settle before the hearing. Knowing exactly what you'll pay upfront prevents surprises and helps you decide whether pursuing the claim makes financial sense.
Current Fee Schedule (Updated July 2026)
The Ministry of Justice sets filing fees under Rule 5 of the Disputes Tribunal Rules 1989, most recently adjusted on 1 July 2026. Here's what you'll pay:
| Claim Amount | Filing Fee (GST inclusive) |
|---|---|
| Under $2,000 | $62.00 |
| $2,000 – $4,999 | $124.00 |
| $5,000 – $30,000 | $248.00 |
| $30,001 – $60,000 | $496.00 |
The top tier was introduced when the Disputes Tribunal Amendment Act 2025 doubled the jurisdictional ceiling from $30,000 to $60,000 on 24 January 2026. It started at $468 and moved to $496 after the Ministry's CPI-linked fee adjustment in July 2026.
If you file online, you pay by Visa or Mastercard. Paper filings lodged at a District Court counter accept EFTPOS, credit card, debit card, or cash.
Can You Get the Filing Fee Back?
The filing fee itself is non-refundable — you don't get it back if you withdraw the claim or the parties settle before the hearing.
However, if you win, the Referee has discretionary power under Section 43 of the Disputes Tribunal Act 1988 to order the losing respondent to reimburse your filing fee as part of the final order. This isn't automatic, so it's worth asking the Referee to include it when you present your claim.
Counterclaims linked to existing proceedings transferred under court direction carry no additional fee under Rule 5(2).
Fee Waivers for Financial Hardship
If you genuinely cannot afford the filing fee, you can apply for a fee waiver. Applications go on the official Ministry of Justice Fee Waiver form and are assessed by a Deputy Registrar against strict financial hardship criteria.
This isn't a rubber-stamp process — you'll need to document your income, assets, and expenses. But if you qualify, it removes the cost barrier entirely.

Other Costs to Factor In
The Disputes Tribunal is a no-costs forum. That means the Referee cannot award legal costs, and you won't be ordered to pay the other side's expenses if you lose. But there are still real costs to consider:
- Evidence preparation: printing photos, obtaining quotes or repair estimates, postage for your evidence bundle
- Time off work: hearings typically run 1–2 hours during business hours
- Witness expenses: if you summons a witness under Rules 14–15, you must tender prescribed conduct money covering their travel
- Demand letter postage: sending your pre-filing demand letter by registered or tracked post (recommended for proof of delivery)
None of these are enormous, but they add up — particularly if your claim is at the lower end. A $500 dispute with a $62 filing fee, $30 in postage and printing, and a half-day off work still makes sense, but it's worth running the numbers first.
Is It Worth Filing?
The filing fee is the easy part of this calculation. The harder question is whether the respondent will actually pay if you win. Disputes Tribunal orders are legally binding, but enforcement requires a separate step through the District Court if the other party ignores the order.
For claims under $2,000, the $62 fee represents a small percentage of what you're owed. For larger claims approaching the $60,000 ceiling, the $496 fee is similarly modest relative to the amount at stake.
Where it gets tricky is when the respondent is a company with few assets. If you win but the company is effectively empty, enforcement becomes difficult regardless of how good your claim was. Checking the respondent's financial position through the Companies Office register before filing can save you both time and the filing fee.
The complete filing guide walks through the full cost picture — from the demand letter through to enforcement — so you can make an informed decision before paying the fee.
