DeSoto County Justice Court Mississippi: Location, Fees, and What to Expect

Where DeSoto County Justice Court Is Located

DeSoto County Justice Court is at 3423 Industrial Drive W. in Hernando, MS 38632. The court handles civil cases where the principal demand is $3,500 or less under Mississippi Code § 9-11-9. That includes contractor disputes, unpaid debts, security deposit claims, and private vehicle sale disagreements.

DeSoto County is one of the busiest Justice Court jurisdictions in northern Mississippi, largely because of the population growth around Southaven, Olive Branch, and Horn Lake. If you've been served with a summons from this court, the papers should list the courthouse address, the assigned judge, and a hearing date.

Filing Fees and Court Costs

The standard civil filing fee in Mississippi Justice Court is $45, set by Mississippi Code § 25-7-25. On top of that, there's a $5 legal assistance fund deposit and constable service fees that typically run $30 to $45 depending on the district. Total initial costs for filing or defending a counterclaim usually land between $84 and $100.

If you can't afford court fees, you can submit an Affidavit of Indigency (also called In Forma Pauperis) to request a waiver. The Justice Court judge reviews the application and may waive upfront fees, though court costs can still be assessed against the losing party after trial.

How Civil Cases Work in DeSoto County Justice Court

Mississippi Justice Courts follow the Rules of Justice Court (RJC), not the Mississippi Rules of Civil Procedure that govern Circuit and County Courts. This distinction matters because Justice Court procedure is simpler in some ways and stricter in others.

One major difference: you don't have to file a written answer to contest a claim. Showing up on the hearing date listed in your summons counts as your full appearance. Default judgments under RJC Rule 23 happen when defendants fail to appear, not when they fail to file paperwork.

That said, if you want to file a counterclaim, you do need to submit it in writing to the clerk, pay the filing fee, and serve a copy on the other party under RJC Rule 14.

What to Bring to Your Hearing

Prepare three identical sets of your evidence — contracts, invoices, photos, text messages, receipts. One set goes to the judge, one to the opposing party, and you keep the third. Justice Court trials are informal compared to Circuit Court, but the judge still expects organized documentation.

If you need a witness to testify, request a subpoena from the Justice Court Clerk under RJC Rule 21. The constable serves it. Do this well in advance of the trial date.

Appeals from DeSoto County Justice Court

If the judge rules against you, Mississippi law gives you 10 calendar days from judgment entry to file a Notice of Appeal with the Justice Court Clerk. The appeal goes to DeSoto County Court or Circuit Court, as applicable, for a trial de novo — a completely new trial, as if the first one never happened.

You'll need to post an appeal bond, typically double the judgment amount plus estimated costs. Miss the 10-day window and the right to appeal is gone permanently.
