Delaware Small Claims Statute of Limitations: Time Limits by Claim Type

Each claim type has its own filing deadline. If the applicable limitation period expires before formal court filing, the action is time-barred regardless of substantive merit. The statute of limitations doesn't care that you only just realized you should sue.

Time Limits by Claim Type

Claim Type Time Limit Statute
Breach of contract (written or oral) 3 years 10 Del. C. § 8106
Property damage / negligence 3 years 10 Del. C. § 8106
Unpaid invoices / debt collection 3 years 10 Del. C. § 8106
UCC sale of goods 4 years 6 Del. C. § 2-725
Security deposit (landlord's notice duty) 20 days (trigger) 25 Del. C. § 5514

The 3-year period under § 8106 covers the majority of JP Court cases: unpaid loans, broken service contracts, contractor disputes, and property damage from car accidents or neighbor negligence. The clock starts on the exact date of the breach, non-payment, or damage — not when you discovered the problem.

How the Clock Starts

Contract claims. The date the other side broke the agreement. If a contractor was supposed to finish by March 1 and didn't, the 3-year clock starts March 1.

Property damage. The date the damage occurred. A neighbor's tree fell on your fence on June 15 — the deadline is June 15 three years later.

UCC goods claims. The date the goods were delivered (or should have been). This covers disputes over physical products — defective merchandise, items that don't match the description.

Security deposits. The landlord's 20-day clock starts after lease termination and delivery of possession. This is the landlord's notice deadline, not the deadline for a tenant to file suit.

Nothing Pauses the Clock

Sending a demand letter, entering settlement negotiations, or participating in mediation does not toll the statute of limitations in Delaware. The clock runs while you're trying to resolve things out of court. If your deadline is approaching, file first and negotiate after — you can always withdraw the case if you reach a settlement.

What Happens When Time Runs Out

If the court finds that the applicable limitation period expired before filing, the claim is time-barred, even if the defendant owes you money.

Practical Advice

If your claim is less than six months from the deadline, move fast. Filing in JP Court is straightforward, but service of process can take time — failed first service means an alias filing, which adds weeks. Get the complaint filed to stop the clock, even if you haven't finished preparing your evidence.

The Delaware filing guide includes a deadline calendar that maps every statutory timeline from demand letter through appeal, so you never hit a deadline you didn't see coming.
